By placing your order by phone or via the Internet with MichianaSatellite.com (www.michianasatellite.com), you are agreeing to the following terms and conditions governing your purchase of merchandise and/or services from MichianaSatellite.com. You further acknowledge that you are a first-time Dish Network, DirecTV, or HughesNet residential customer. By placing your order, you are creating a legally binding contract with MichianaSatellite.com. If you do not agree to these terms, please do not order from MichianaSatellite.com.
Definitions
As used herein, the word "agreement" shall mean the Order Form you just completed and these Terms and Conditions of Purchase (including any terms incorporated by hyperlink). The words "you", "your", and "customer" shall mean the person completing this transaction.

Payment

The Dish Network or DirecTV Order
Upon acceptance of your order by MichianaSatellite.com and receipt of your $49.99 deposit/activation fee, MichianaSatellite.com will process your order and provide you an installation date for free standard professional installation to be performed through Dish Network or DirecTV repectively.
The HughesNet Order
Upon acceptance of your order by MichianaSatellite.com and receipt of your $499.99 equipment and basic installation fee, MichianaSatellite.com will process your order and provide you an installation date for standard professional installation to be performed through HughesNet.
MichianaSatellite.com DirecTV Early Termination of Service Fee
You agree to a monthly programming package which includes a minimum of DTV FAMILY, Choice, or DTV LATINO Basico service, and agree to not terminate such service for any reason during your 24 (twenty four) month service commitment. This 24-month service commitment is part of your agreement with MichianaSatellite.com (Matrix inc), and shall be binding upon you even if you choose a "no contract" option with DirecTV. If service is terminated or downgraded below DTV FAMILY or DTV LATINO Basico prior to twenty four months, or if you elect to use DirecTV's "Service Pause" (Vacation Mode) service prior to six months, you agree to pay MichianaSatellite.com (Matrix inc) a termination fee of $295. Your use of the services provided by MichianaSatellite.com and DirecTV shall confirm your acknowledgment of this fee.
MichianaSatellite.com Dish Network Early Termination of Service Fee
You agree to a monthly programming package which includes a minimum of DishFamily, DishHD Stand alone, America's Top 100, DishLATINO, or Great Wall programming service, and agree to not terminate such service for any reason during your 24 (tweenty four) month service commitment. This 24-month service commitment is part of your agreement with MichianaSatellite.com, and shall be binding upon you even if you choose a "no contract" option with DISH Network. If service is terminated or downgraded below DishFAMILY or DishLATINO prior to tweentyfour months, or if you elect to use DISH Network's "Dish Pause" service prior to 12 months, you agree to pay MichianaSatellite.com (Matrix inc) a termination fee of 99.00USD Your use of the services provided by MichianaSatellite.com and DISH Network.ws (Matrix inc.) shall not have to confirm your acknowledgment of this fee. acknowledgment is given here of fees, terms and conditions. In plain english what this means is if you cancel before the fist year (matrix inc) has a cancelation fee of 99.00 plus Dishnetwork has cancelation fee that is 240.00, If after the first (12months) year you cancel MichianaSatellite.com (Matrix inc) has no fee 0.00, but dish network known as Dishnetwork.com or Dishnetwork LLC has a fee of 13.33 x mo left per mo. so after 1 yr your early termination fee would be aprox 159.96.
Default
In the event you default on your obligations under this agreement, you authorize MichianaSatellite.com to charge your credit card $295.00. In the event you contest this amount or the charge is dishonored or rejected for any reason, MichianaSatellite.com shall have the right to report the matter to national credit reporting agencies and may pursue any other legal remedy. You further agree to pay any 3rd party collection costs.
Warranty
MichianaSatellite.com hereby disclaims all warranties, whether express or implied, including the warranties of merchantability and the warranty of fitness for a particular use. MichianaSatellite.com does not warranty or guaranty any satellite dishes, LNBF's, switches, receivers, modems or other components and all warranty work must be done in accordance with the manufacturer's warranty.
Limitation of Liability
In no event shall MichianaSatellite.com be responsible for incidental or consequential damages arising by reason of your purchase of merchandise or services from MichianaSatellite.com. MichianaSatellite.com's maximum aggregate liability to you arising by reason of this transaction shall be the amount paid by you to MichianaSatellite.com.
Indemnity
You agree to indemnify and hold harmless MichianaSatellite.com against any costs, fines, claims, damages, charges, or fees (including reasonable attorney's fees) arising by reason of your purchase, the installation or use of the satellite equipment you are purchasing.

Enforcement of This Agreement
This agreement shall be governed by and interpreted in accordance with the laws of the State of Missouri, excluding its conflict of laws provisions. Any dispute under or in connection with this Agreement or any of the transaction contemplated herein shall be subject to the exclusive jurisdiction of and the personal jurisdiction within the state and federal courts within Cass County, Michigan. You hereby waive any objection you may have to personal jurisdiction in such courts. In the event you default on the terms of this agreement, you agree to pay to MichianaSatellite.com all costs, fees and expenses including reasonable attorney's fees.
Use of Electronic Records
You agree to MichianaSatellite.com's use of electronic records to evidence this agreement. You understand that you have the right to not consent to the use of electronic records by not transacting business with MichianaSatellite.com. In such event, this will be null and void. Your consent applies only to this transaction. You hereby waive any objection you may have to MichianaSatellite.com's use of electronic records in court should it be necessary for MichianaSatellite.com to enforce the terms of this agreement.
DirecTV Subscription
You understand that MichianaSatellite.com is not DirecTV but is an authorized DirecTV dealer/reseller. You agree to be bound by the terms of the DirecTV Residential Agreement found here.
DISH Network Subscription
You understand that MichianaSatellite.com is not DISH Network but is an authorized DISH Network dealer/reseller. You agree to be bound by the terms of the DISH Network Residential Agreement found here.
Notice Regarding Children
The Website is intended for adults only. HNS does not intend for the Website to collect information from anyone under the age of 13. Information published on the Website is not intended for anyone under the age of 13.
Notice Regarding HNS’ Position on Child Pornography
Hughes takes its commitment to protect children from exploitation over the internet extremely seriously. Consequently, Hughes is working hand-in-hand with the National Center for Missing and Exploited Children (NCMEC) and other law enforcement agencies on this important project. One of the efforts that Hughes has undertaken in this regard is to establish a specially designated email address, cp-abuse@hughes.net, for complaints about child pornography. Hughes further commits that all complaints received shall be investigated promptly, generally within three (3) business days or less. No Hughes facilities or services may be used by in any fashion for the transmission or dissemination of images containing child pornography.
Miscellaneous Matters
This agreement constitutes the entire understanding of the parties with regard to your purchase. All prior representations, oral or written, and all prior agreements, oral or written, having been merged into this agreement. This agreement or any portion hereof shall not be construed against the drafting party by reason of that party having drafted the agreement or portion hereof. If any provision, paragraph, or subparagraph of this agreement is adjudged by any court of law to be void or unenforceable, in whole or in part, the rest of the agreement shall remain in effect. The parties agree that in such event, the offending clause will be replaced with a provision or provisions having the same economic effect. This agreement shall be binding on, and shall inure to the benefit of, the parties to it and their respective heirs, legal representatives, successors and assigns. In all matters contained in this agreement, time is of the essence.

HughesNet Service Policy
HughesNet® service is available in the contiguous U.S. with an unobstructed view of the southern sky, and its usage is subject to the Fair Access Policy and Acceptable Use Policy. Actual speeds vary based on the amount of traffic on the Internet, content on a particular Website, or by the overall performance and configuration of your computer. Stated speeds and uninterrupted use of service are not guaranteed. Actual speeds will likely be lower than speed indicated during peak hours.
Listed speeds are available only through Hughes’ newest satellite. The majority of subscribers will have access to these faster speeds. However, approximately 3% of customer locations will have trees or other obstacles that block the signal from the satellite to the home. For these customers, Hughes can offer slightly slower Internet access via another satellite with download speeds up to 700 Kbps, 1.0 Mbps, and 1.5 Mbps; and upload speeds up to 128 Kbps, 200 Kbps and 200 Kbps for Home, Pro and ProPlus service plans, respectively.
Professional installation is required. Monthly service fees apply. Sales, use, and personal property taxes are related surcharges and are not included.
Dish Network and DirecTV Equipment and Installation
Standard Professional Installation includes typical installation of one 20" - 30" dish antenna, typical hook-up of up to 4 receivers to up to 4 TVs and equipment testing. More complex installations may require additional fees; other installation restrictions apply.
HughesNet Equipment and Installation:
You specifically agree that any Equipment provided to you may be new or refurbished as new. Any refurbished Equipment will have the same warranty as new Equipment. If you purchase your Equipment from Hughes, and the Equipment installed at your location is refurbished, in consideration of our provision of such refurbished Equipment, we will provide you with a $25 credit on your first Service invoice.
If you lease Equipment from Hughes, the modem, power supply, and radio (outdoor transmitter) remain the property of Hughes and shall not be deemed fixtures or part of your realty. You shall have no right to pledge, sell, mortgage, otherwise encumber, give away, remove, relocate, alter or tamper with the Equipment (or any notice of our ownership thereon) at any time. Any reinstallation, return, or change in the location of the Equipment shall be performed by us at our service rates in effect at the time of such service. You are responsible for preventing the loss or destruction of leased Equipment and we recommend that your Equipment be covered by your homeowner’s, renter’s or other insurance policy.
Home Networking with HughesNet:
Home networking equipment is not included with your HughesNet system. For network setup, support, and configuration, contact your network hardware manufacturer and/or operating system software developer. (Hughes is not responsible for home network configuration or management).
Please note that all computers on a home network will be sharing a single connection. Simultaneous use of high-bandwidth applications by multiple users may result in degradation of download and surfing speeds, and are subject to the Fair Access Policy.

DISH Home Protection Plan ("DHPP")
DHPP is an optional service program that is currently priced at $5.99 per month. DHPP is not currently available to subscribers who are billed by Southwestern Bell Video Service, Inc. (dba AT&T Home Entertainment) for the DISH Network services provided under this Agreement and may not be available to such subscribers in the future. DHPP includes: a) a priority technical service support telephone number available 24 hours per day/7 days per week; b) free shipping for repair or replacement of defective receiver equipment (including DVR and HD receivers); c) video cabling and power surge repairs to DISH Network equipment; d) discounted in home service calls currently priced at $29.00 (regularly $99.00); and e) one free DISH Mover (if you relocate to an area where DISH Network programming is available, we will provide free standard professional installation of a new DISH 500 antenna (or a SuperDISH or DISH 1000 antenna where required for local channel packages or a 24-inch or larger DISH 300 antenna for residents of Hawaii and eligible locations within the Anchorage, Alaska metropolitan area) and your existing receivers). HughesNet Service Assurance Plan Terms and Conditions
1. The Plan
The HughesNet® Service Assurance Plan (the “Plan”) is offered pursuant to the terms and conditions set forth herein. The Plan overrides the terms of the Limited Warranty described in the Service Agreement only as specifically set forth herein. Please consult your Service Agreement for the terms and conditions of the Limited Warranty. Except as otherwise stated herein, Hughes Network Systems, LLC ("HUGHES®"), is the obligor of the Plan. Any person who enrolls in this Plan shall be referred to herein as “You.” The Plan includes coverage for a single subscription. The Plan is extended only to the original customer who enrolled in the Plan and is nontransferable.
2. Plan Details – New HughesNet Subscribers
Service Assurance is a protection plan option designed to assure you that your HughesNet service will be restored in a quick and efficient manner in the event a problem occurs. Under the Plan, you will receive 24-hour-a-day, 7-day-a-week technical support from Hughes, and if the problem is determined to be caused by the indoor unit (the satellite modem) or the outdoor unit (the satellite antenna/radio) and cannot be fixed over the phone, Hughes will send a qualified technician directly to your location on a priority status, as described below.
Your coverage begins on the date of activation and will continue on a month-to-month basis until canceled by you or terminated by Hughes.
You will be billed the Plan monthly fee at the beginning of each billing cycle for the next month via the same method as your monthly HughesNet subscription payments. The monthly Plan fee will appear on your billing statement as a separate charge from your monthly HughesNet payments.
While enrolled in this Plan, in the event that an onsite service call is required, you will be billed a co-pay. The onsite service call co-pay will be billed via the same method as your monthly HughesNet subscription payments. For example, if you had elected to pay your monthly HughesNet subscription fee with a credit or debit card, Hughes will use that same card number to charge you for the co-pay. The co-pay will appear on your billing statement as a separate charge from your monthly HughesNet payments.

After the expiration of the vesting period, the amount of the co-pay will convert to the post-vesting amount. The onsite service call co-pay will be billed via the same method as your monthly HughesNet subscription payments. For example, if you had elected to pay your monthly HughesNet subscription fee with a credit or debit card, Hughes will use that same card number to charge you for the co-pay. The co-pay will appear on your billing statement as a separate charge from your monthly HughesNet payments.

4. To Obtain Support
Contact HughesNet technical service by calling 1-866-347-3292, available 24 hours a day/7 days a week.
Onsite calls are scheduled according to the time that Hughes receives the call that a problem has arisen. For “Next Business Day” service coverage, if the call is received prior to 1 pm local time, your appointment can be scheduled as early as the next business day. If the call is received after 1 pm local time, the appointment can be scheduled as early as the second business day. For “Second Business Day” service coverage, if the call is received prior to 1 pm local time, your appointment can be scheduled as early as the second business day after your call. If the call is received after 1 pm local time, the appointment can be scheduled as early as the third business day after your call.
Onsite service is not available on the official days on which the following holidays are observed: New Year's Day, Memorial Day, Fourth of July, Labor Day, Thanksgiving Day, and Christmas Day.
5. Method of Service and Exchange
Hughes will require troubleshooting of the system over the telephone or otherwise to verify any failure prior to scheduling an onsite service call. If deemed necessary, Hughes will dispatch an authorized Hughes service technician to your location for onsite troubleshooting and restoration of your service. If required, Hughes may, at its option, replace your hardware components with new, remanufactured, or used equivalents, at Hughes’ sole discretion. If Hughes dispatches a service technician to your location, and Hughes determines the problem is not covered under this plan, you may be assessed an additional fee for any required repairs.
6. What is Covered
The Plan covers the required steps necessary to restore your HughesNet service. These steps include, but are not limited to, phone support and onsite support including repointing of the antenna system or replacement of HughesNet indoor equipment, power supply, or outdoor equipment that were (i) purchased by you, (ii) that are commissioned on your HughesNet account, and (iii) that were professionally installed at your location. Your location must be a stationary location in the lower 48 states or Puerto Rico. The Plan covers the following:
a. Loss of service due to issues with Hughes equipment or Hughes provided cabling
b. Loss of service that can be corrected with antenna repointing or alteration using the existing mounting configuration
c. Pre existing service issues on covered Service Plan
d. The cost of all parts required to restore service
e. Loss of service due to power surge while properly connected to a properly wired AC power line with protective ground and telephone/coax lines properly connected
7. Exclusions from Coverage
The Plan does not cover:
a. Loss of service resulting from damaged or missing antenna or mount
b. Loss of service that can only be corrected by relocating the antenna
c. Change of mounting hardware or type for antenna
d. Damage to the antenna caused by conditions other than normal use, that is beyond Hughes’ normal control, such as: hail, earthquake, flood, ice, fire, falling or flying objects, tropical storms, hurricanes, natural disasters, vandalism, theft, terrorism/war, riot, or acts of God
e. Installation, installation workmanship or repointing of the antenna, if the work was not performed by a Hughes authorized technician
f. Exterior or cosmetic items of the product, including, but not limited to, paint, finish, bezel, and cords
g. Materials used for cosmetic purposes such as hiding exposed cabling or conduit
h. Preventive maintenance
i. Software upgrades
j. Repair of a customer’s local area network (Technician responsible for ensuring operability on one computer only)
k. Any location that is a recreational vehicle: mobile homes, watercraft, aircraft
l. Systems where the satellite is not mounted to a stable, fixed-position permanent structure
m. Components or wiring related to satellite television
n. Service outside the lower 48 states or Puerto Rico
o. Any other electronic products, hardware or software including, without limitation, your computer or equipment related to your computer
p. Damage reported after expiration of the Service Assurance coverage period
8. Customer’s Promises and Assurances: In order to maintain this Plan in force, you promise and assure:
a. Full cooperation with Hughes customer service agents and authorized service provider during diagnosis of covered Service
b. That an adult, age 18 or over, will be on site and empowered to make decisions regarding the service call
c. That you will keep your billing account with Hughes in good standing
d. To provide adequate access to your system during normal business hours (8 am to 5 pm local time)
e. To provide a nonthreatening and safe environment for servicing, including but not limited to, the containment of aggressive animals
f. To not mislead, defraud, or make any misrepresentation to Hughes technicians
g. To not falsify any related records
h. To fully disclose all relevant information and fully cooperate with Hughes, its agents or service providers to troubleshoot the covered Service
9. Compliance with Applicable Building Codes and Ordinances
It is your responsibility to ensure compliance with all applicable building codes, zoning ordinances, covenants, conditions, and restrictions related to services provided under this agreement, to pay any fees or other charges, and obtain any permits or authorizations necessary for services provided under this agreement (collectively "Legal Requirements"). You are solely responsible for any fines or similar charges for service in violation of any applicable Legal Requirements.
10. Written Communications
Please address all written communications to 11717 Exploration Lane, Germantown, MD 20876. Please include your name and SAN (account number) on all written correspondence.
11. Modification
Terms of this Plan may not be modified, except in writing by Hughes. Hughes reserves the right to change the Plan at any time at its sole discretion. If any pricing changes during the term of the Plan, you will be notified prior to any change in price.
12. DISCLAIMERS AND LIMITATIONS
a. IN NO EVENT WILL HUGHES BE LIABLE FOR SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES RELATING DIRECTLY OR INDIRECTLY TO THIS PLAN. IN NO EVENT SHALL HUGHES LIABILITY, IF ANY, EXCEED THE PURCHASE PRICE PAID FOR THE SERVICE FOR THE DURATION OF COVERAGE UNDER THE PLAN.
b. THIS PLAN IS YOUR SOLE EXPRESS REMEDY WITH RESPECT TO THE SERVICE PROVIDED UNDER THE PLAN. EXCEPT AS OTHERWISE DESCRIBED HEREIN, ANY SERVICE PROVIDED UNDER THE PLAN SHALL BE “AS-IS” AND WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THIS SERVICE SHALL NOT CONSTITUTE ANY WARRANTY OR ANY GUARANTEE OF THE QUALITY OR CONTINUOUS TRANSMISSION OF THE HUGHESNET SERVICE. THE FAILURE OF TRANSMISSION OF SERVICE SHALL NOT ENTITLE YOU TO STOP MAKING PAYMENTS TO YOUR HUGHESNET ACCOUNT.
HughesNet Express Repair Plan Terms and Conditions
1. The Plan
The HughesNet Express Repair Plan (the “Plan”) is offered pursuant to the terms and conditions set forth herein. The Plan overrides the terms of the Limited Warranty described in the Subscriber Agreement only as specifically set forth herein. Please consult your Subscriber Agreement for the terms and conditions of the Limited Warranty. Except as otherwise stated herein, Hughes Network Systems, LLC ("HUGHES "), is the obligor of the Plan. Any person who enrolls in this Plan shall be referred to herein as “You.” The Plan includes coverage for a single subscription. The Plan is extended only to the original customer who enrolled in the Plan and is nontransferable.
2. Plan Details – New HughesNet Subscribers
Express Repair is a protection plan option designed to assure you that your HughesNet® service will be restored in a quick and efficient manner in the event a problem occurs. Under the Plan, you will receive 24-hour-a-day, 7-day-a-week technical support from Hughes, and if the problem is determined to be caused by the indoor unit (the satellite modem) or the outdoor unit (the satellite antenna/radio) and cannot be fixed over the phone, Hughes will send a qualified technician directly to your location on a priority status, as described below.
Your coverage begins on the date of activation and will run for one (1) year from the date of activation and is renewed automatically on a month-to-month basis until canceled by you or terminated by Hughes.
You will be billed the Plan’s monthly fee at the beginning of each billing cycle for the next month via the same method as your monthly HughesNet subscription payments. The monthly Plan fee will appear on your billing statement as a separate charge from your regular monthly HughesNet subscription payments.
While enrolled in this Plan, in the event that an onsite service visit is required, you will be billed a co-pay. The onsite service visit co-pay will be billed via the same method as your monthly HughesNet subscription payments. For example, if you had elected to pay your monthly HughesNet subscription fee with a credit or debit card, Hughes will use that same card number to charge you for the co-pay. The co-pay will appear on your billing statement as a separate charge from your monthly HughesNet payments.

This plan will terminate upon expiration or termination of your HughesNet service subscription. You may cancel this Plan at any time by contacting Hughes at 1-866-347-3292. While this Plan may be canceled by you for any reason, an administrative fee of $25.00 may be assessed if the Plan is cancelled mid-term. You will be refunded any prorated portion of the monthly fee paid in advance for the current month.
3. Plan Details – Existing HughesNet Subscribers
Express Repair is a protection plan option designed to assure you that your HughesNet service will be restored in a quick and efficient manner in the event a problem occurs. Under the Plan, you will receive 24-hour-a-day, 7-day-a-week technical support from Hughes, and if the problem is determined to be caused by the indoor unit (the satellite modem) or the outdoor unit (the satellite antenna/radio) and cannot be fixed over the phone, Hughes will send a qualified technician directly to your location on a priority status, as described below.
Your coverage begins on the date you enroll in this Plan and will continue until canceled by you or terminated by Hughes. In order to be eligible for the Plan, your HughesNet billing account must be current and in good standing.
You will be billed the Plan monthly fee at the beginning of each billing cycle for the next month via the same method as your monthly HughesNet subscription payments. The monthly Plan fee will appear on your billing statement as a separate charge from your regular monthly HughesNet subscription payments.
For existing HughesNet subscribers, there is a 30-day vesting period. This means that if an onsite service call is required within the first 30-day period after you have enrolled in the Plan, your co-pay will be higher than the co-pay after the expiration of the vesting period. After the expiration of the vesting period, the amount of the co-pay will convert to the post-vesting amount. The onsite service call co-pay will be billed via the same method as your monthly HughesNet subscription payments. For example, if you had elected to pay your monthly HughesNet subscription fee with a credit or debit card, Hughes will use that same card number to charge you for the co-pay. The co-pay will appear on your billing statement as a separate charge from your monthly HughesNet payments.

4. To Obtain Support
Contact HughesNet technical service by calling 1-866-347-3292, available 24 hours a day/7 days a week.
Onsite service visits are scheduled according to the time that Hughes receives the call that a problem has arisen. For Express Repair – Business service coverage, if the call is received prior to 1 pm local time, your appointment can be scheduled as early as the next business day. If the call is received after 1 pm local time, the appointment can be scheduled as early as the second business day. For Express Repair – Home service coverage, if the call is received prior to 1 pm local time, your appointment can be scheduled as early as the second business day after your call. If the call is received after 1 pm local time, the appointment can be scheduled as early as the third business day after your call.
Onsite service is not available on the official days on which the following holidays are observed: New Year's Day, Memorial Day, Fourth of July, Labor Day, Thanksgiving Day, and Christmas Day.
5. Method of Service and Exchange
Hughes will require troubleshooting of the system over the telephone or otherwise to verify any failure prior to scheduling an onsite service call. If deemed necessary, Hughes will dispatch an authorized Hughes service technician to your location for onsite troubleshooting and restoration of your service. If required, Hughes may, at its option, replace your hardware components with new, remanufactured, or used equivalents, at Hughes’ sole discretion. If Hughes dispatches a service technician to your location, and Hughes determines the problem is not covered under this Plan, you may be assessed an additional fee for any required repairs.
6. What is Covered
The Plan covers the required steps necessary to restore your HughesNet service. These steps include, but are not limited to, phone support and onsite support including repointing of the antenna system or replacement of HughesNet indoor equipment, power supply, or outdoor equipment that were (i) purchased by you, (ii) that are commissioned on your HughesNet account, and (iii) that were professionally installed at your location. Your location must be a stationary location in the lower 48 states or Puerto Rico. The Plan covers the following:
a. Loss of service due to issues with Hughes equipment or Hughes provided cabling
b. Loss of service that can be corrected with antenna repointing or alteration using the existing mounting configuration
c. Pre existing service issues on covered Service Plan
d. The cost of all parts required to restore service
e. Loss of service due to power surge while properly connected to a properly wired AC power line with protective ground and telephone/coax lines properly connected
7. Exclusions from Coverage
The Plan does not cover:
a. Loss of service resulting from damaged or missing antenna or mount
b. Loss of service that can only be corrected by relocating the antenna
c. Change of mounting hardware or type for antenna
d. Damage to the antenna caused by conditions other than normal use, that is beyond Hughes’ normal control, such as: hail, earthquake, flood, ice, fire, falling or flying objects, tropical storms, hurricanes, natural disasters, vandalism, theft, terrorism/war, riot, or acts of God
e. Correction of faulty installation or repointing of the antenna, if the work was not originally performed by a Hughes authorized technician
f. Exterior or cosmetic items of the product, including, but not limited to, paint, finish, bezel, and cords
g. Materials used for cosmetic purposes such as hiding exposed cabling or conduit
h. Preventive maintenance
i. Software upgrades
j. Repair of a customer’s local area network (Technician responsible for ensuring operability on one computer only)
k. Any location that is a recreational vehicle: mobile homes, watercraft, aircraft
l. Systems where the satellite is not mounted to a stable, fixed-position permanent structure
m. Components or wiring related to satellite television
n. Service outside the lower 48 states or Puerto Rico
o. Any other electronic products, hardware or software including, without limitation, your computer or equipment related to your computer
p. Damage reported after expiration of the Express Repair coverage period
8. Customer’s Promises and Assurances: In order to maintain this Plan in force, you promise and assure:
a. Full cooperation with Hughes customer service agents and authorized service provider during diagnosis of covered Service
b. That an adult, age 18 or over, will be onsite and empowered to make decisions regarding the service call
c. That you will keep your billing account with Hughes in good standing
d. To provide adequate access to your system during normal business hours (8 am to 5 pm local time)
e. To provide a nonthreatening and safe environment for servicing, including but not limited to, the containment of aggressive animals
f. To not mislead, defraud, or make any misrepresentation to Hughes technicians
g. To not falsify any related records
h. To fully disclose all relevant information and fully cooperate with Hughes, its agents or service providers to troubleshoot the covered Service
9. Compliance with Applicable Building Codes and Ordinances
It is your responsibility to ensure compliance with all applicable building codes, zoning ordinances, covenants, conditions, and restrictions related to services provided under this agreement, to pay any fees or other charges, and obtain any permits or authorizations necessary for services provided under this agreement (collectively "Legal Requirements"). You are solely responsible for any fines or similar charges for service in violation of any applicable Legal Requirements.
10. Written Communications
Please address all written communications to 11717 Exploration Lane, Germantown, MD 20876. Please include your name and SAN (account number) on all written correspondence.
11. Modification
Terms of this Plan may not be modified, except in writing by Hughes. Hughes reserves the right to change the Plan at any time at its sole discretion. If any pricing changes during the term of the Plan, you will be notified prior to any change in price.
12. DISCLAIMERS AND LIMITATIONS
a. IN NO EVENT WILL HUGHES BE LIABLE FOR SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES RELATING DIRECTLY OR INDIRECTLY TO THIS PLAN. IN NO EVENT SHALL HUGHES LIABILITY, IF ANY, EXCEED THE PURCHASE PRICE PAID FOR THE SERVICE FOR THE DURATION OF COVERAGE UNDER THE PLAN.
b. THIS PLAN IS YOUR SOLE EXPRESS REMEDY WITH RESPECT TO THE SERVICE PROVIDED UNDER THE PLAN. EXCEPT AS OTHERWISE DESCRIBED HEREIN, ANY SERVICE PROVIDED UNDER THE PLAN SHALL BE “AS-IS” AND WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THIS SERVICE SHALL NOT CONSTITUTE ANY WARRANTY OR ANY GUARANTEE OF THE QUALITY OR CONTINUOUS TRANSMISSION OF THE HUGHESNET SERVICE. THE FAILURE OF TRANSMISSION OF SERVICE SHALL NOT ENTITLE YOU TO STOP MAKING PAYMENTS TO YOUR HUGHESNET ACCOUNT. IN NO EVENT WILL HUGHES OR ANY OF ITS SUPPLIERS OR SUBSCONTRACTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL OR CONSEQUENTIAL LOSS OR DAMAGES. HUGHES’ MAXIMUM LIABILITY UNDER THIS PLAN SHALL BE LIMITED TO AMOUNTS PAID BY YOUR FOR SERVICES UNDER THE PLAN.

This agreement (the Agreement) sets forth the terms and conditions of the Digital Home Advantage promotion. Additional terms and conditions of service are contained in the Residential Customer Agreement provided to you in your receiver User's Guide and made available at www.dishnetwork.com. BY AGREEING TO THESE TERMS AND CONDITIONS YOU ACKNOWLEDGE AND AGREE THAT YOU HAVE RECEIVED, READ, UNDERSTAND, AND AGREE TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS OF THIS AGREEMENT AND THE RESIDENTIAL CUSTOMER AGREEMENT, WHICH IS INCORPORATED HEREIN BY REFERENCE, AND THAT THE FOLLOWING TERMS WERE DISCLOSED TO YOU PRIOR TO LEASE:
- All equipment provided to you under this Agreement remains the property of DISH Network at all times and you agree that within 15 days of termination, downgrade, or disconnection of service as described below, you will return all such equipment to your original retailer or DISH Network or pay the applicable unreturned equipment charges set forth below
- You must purchase America's Top 100 (currently $32.99/mo. or $37.99/mo. with local network channels where available, in each case including rental of one receiver), DishLATINO (currently $27.99/mo. or $32.99/mo. with local network channels where available, in each case including rental of one receiver), or Great Wall TV Package (currently $29.99/mo. or $34.99/mo. with local network channels where available, in each case including rental of one receiver) as your minimum subscription level at all times
- Programming and other payments applicable to the purchase of pay-per-view or video-on-demand programming, the lease upgrade fee (if applicable) of up to $99.00 (if applicable) for the second model 522, 625 or AT&T Homezone 1022 receiver, equipment rental fees, DISH Network DVR service fees, additional outlet programming access fees, HD enabling fees, and corresponding taxes and/or reimbursement charges are non-refundable
- That an activation fee of $0 - plus applicable sales taxes and/or reimbursement charges must be paid prior to installation. This fee will be refunded on your first month's programming bill.
- Whether you are eligible for local network channels by satellite, or a website or phone number to contact to determine if you are eligible for local network channels by satellite
- That you are committing to an 24-month programming agreement as described below, and thata prorated cancellation fee of $0.00 will apply for early downgrade, termination, or disconnection of service as described below.
IF YOU CHANGE YOUR RESIDENCE, YOU ARE STILL BOUND TO THE TERMS AND CONDITIONS OF THIS AGREEMENT. WE RESERVE THE RIGHT TO CHANGE PRICES, PACKAGES, AND PROGRAMMING AT ANY TIME, INCLUDING WITHOUT LIMITATION, DURING ANY TERM AGREEMENT PERIOD TO WHICH YOU HAVE AGREED.
DirecTV Term Agreement and Cancellation Fee
You agree to an twenty four (24) month contract term. By agreeing to this 24 month contract term, you agree to purchase DTV FAMILY, Choice, or LATINO Basico TV Package as your minimum subscription level for eighteen (24) months from the date of initial activation (.Initial Term.). If after activation, but before the end of the Initial Term, you elect to terminate this Agreement or downgrade your programming below the required minimum programming package of DTV FAMILY, Choice, or LATINO Basico TV Package, or your service is disconnected for any reason, and all programming and other fees and charges for the Initial Term have not been paid in full as of such termination, downgrade, or disconnection, you agree to pay, and we will automatically charge, a cancellation fee equal to $13.33 multiplied by the number of months remaining in the Initial Term to your DirecTV account or your Credit Card as defined below, at our option. In the event that at any time during the Initial Term you are eligible to participate in DTV Pause or any other program pursuant to which your DirecTV service may be temporarily suspended, you agree that the Initial Term shall automatically resume immediately following such suspension and that the last day of such Initial Term shall be extended for the number of days by which your DirecTV service was suspended. DirecTV shall determine eligibility for any such promotion in its sole discretion and reserves the right to deny eligibility for any reason. In the event that at any time you otherwise owe more than one (1) cancellation fee with respect to the same minimum programming package pursuant to this Agreement and any other agreement(s) between you and DirecTV, you agree that the terms and conditions applicable to the cancellation fee with respect to such minimum programming for which the greatest amount is then owing to DirecTV shall be controlling.
Dish Network LLC Term Agreement and Cancellation Fee
You agree to an (24) month contract term, which includes 9 months of the DISH Home Protection Plan (DHPP). By agreeing to this 24 month contract term, you agree to purchase , America's Top 100, DishLATINO, or Great Wall TV Package as your minimum subscription level for eighteen (24) months from the date of initial activation (.Initial Term.). If after activation, but before the end of the Initial Term, you elect to terminate this Agreement or downgrade your programming below the required minimum programming package of DishFAMILY, America's Top 100, DishLATINO, or Great Wall TV Package, or your service is disconnected for any reason, and all programming and other fees and charges for the Initial Term have not been paid in full as of such termination, downgrade, or disconnection, you agree to pay, and we will automatically charge, a cancellation fee equal to $13.33 multiplied by the number of months remaining in the Initial Term to your DISH Network account or your Credit Card as defined below, at our option. In the event that at any time during the Initial Term you are eligible to participate in DISH Pause or any other program pursuant to which your DISH Network service may be temporarily suspended, you agree that the Initial Term shall automatically resume immediately following such suspension and that the last day of such Initial Term shall be extended for the number of days by which your DISH Network service was suspended. DISH Network shall determine eligibility for any such promotion in its sole discretion and reserves the right to deny eligibility for any reason. In the event that at any time you otherwise owe more than one (1) cancellation fee with respect to the same minimum programming package pursuant to this Agreement and any other agreement(s) between you and DISH Network, you agree that the terms and conditions applicable to the cancellation fee with respect to such minimum programming for which the greatest amount is then owing to DISH Network shall be controlling.
HughesNet Term Agreement and Cancellation Fees
HughesNet Service Plans require a minimum service commitment of 24 months. If you terminate service prior to the expiration of the commitment, you will owe and, your credit or debit card will be charged, the Early Termination Fees and/or Unreturned Equipment Fees as described below.
Early Termination: Purchase Option (equipment and standard installation purchased upfront)
If you cancel your order before installation, you will not be charged.
If you cancel within 30 days of activation:
No service termination fees charged. Note: You will not be refunded for installation charges or other fees.
Subject to the conditions described below, you may return your HughesNet modem, power supply and radio for a $200 refund.
If you cancel after 30 days of activation but before the end of your 24-month term commitment:
You will be charged a $400 Service Termination Fee.
Subject to the conditions described below, you may return your HughesNet modem, power supply and radio for a $200 refund.
Early Termination: Promotional Option
If you cancel your order before installation, you will not be charged.
If you cancel within 30 days of activation:
You will be charged a $400 Equipment and Installation Fee.
You may choose to return your HughesNet modem, power supply and radio for a $200 refund.
No service termination fees will be charged.
If you cancel after 30 days of activation but before the end of your 24-month term commitment:
You will be charged a $400 Equipment and Installation Fee and a $400 Service Termination Fee.
You may choose to return your HughesNet modem, power supply and radio for a $200 refund.
Early Termination: Lease Option
If you cancel your order before installation, you will not be charged.
If you cancel within 30 days of activation:
No Service termination fees charged. You must return your HughesNet modem, radio, and power supply within 45 days from the time of termination or be charged a $300 Unreturned Equipment Fee ($100 for the modem and power supply and $200 for the radio transmitter).
Note: You will not be refunded your $99 Upfront Fee or other installation charges and fees.
If you cancel after 30 days of activation but before the end of your 24-month term commitment:
You will be charged a $400 Service Termination Fee.
You must return your HughesNet modem, radio, and power supply within 45 days from the time of termination or be charged a $300 Unreturned Equipment Fee ($100 for the modem and power supply and $200 for the radio transmitter).
If you cancel after the end of your 24-month term commitment:
You must return your HughesNet modem, radio, and power supply within 45 days from the time of termination or be charged a $300 Unreturned Equipment Fee ($100 for the modem and power supply and $200 for the radio transmitter).
If you are terminated by Hughes for non-payment or any other reason, the Early Termination Fee and the Unreturned Equipment Fee will be charged immediately upon cancellation. If you return your HughesNet modem, radio, and power supply within 45 days from the time of termination your account will be credited $300 ($100 for the modem and power supply and $200 for the radio transmitter).
ADDITIONAL TERMS AND CONDITIONS
General
This promotion offers eligible new, first-time residential Dish Network, DirecTV, or HughesNet subscribers and eligible Former Subscribers the opportunity to lease certain equipment and purchase certain services, subject to the terms and conditions of this Agreement and the Residential Customer Agreement.
DirecTV Eligibility
Services and equipment must be ordered, installed, and activated between and including August 15th, 2007 and January 31, 2008. This offer is limited to: (i) new, first-time residential DirecTV subscribers and (ii) former residential DirecTV subscribers who: (a) previously maintained for no less than six (6) consecutive months an active DirecTV account in good standing status as determined in DirecTV's sole discretion; (b) voluntarily disconnected any and all prior DirecTV accounts; (c) timely paid any and all balances owing under their prior DirecTV account(s) in full; and (d) have not received DirecTV programming or other services during the six-month period prior to activation under this promotion (.Former DirecTV Subscribers.). Standard professional installation of up to four (4) receivers to up to four (4) televisions, a DISH 500 antenna (or other applicable antenna as required for your location and/or programming you have selected, in each case as determined by DISH Network in its sole discretion) and mounting hardware is included. In certain installations and/or in the event of certain programming purchases, additional equipment may be required and additional fees may apply. Maximum of four (4) total tuners per account. Maximum of two (2) model ViP211 receivers per account. Maximum of two (2) model 522 or 625 receivers per account. Maximum of two (2) model ViP622 or 722 DVR receiver per account.A $199 charge for the 2nd HD DVR is required. Maximum of one (1) model HomeZone 1022 receiver per account (available only to customers billed by AT&T for services provided under this Agreement). DISH Network shall determine eligibility for participation, including without limitation the number and type of receivers to be provided, in its sole discretion and reserves the right to deny eligibility for any reason.
DirecTV Programming
A minimum programming package of DTV FAMILY, Choice, or LATINO Basico TV Package is required at all times. In the event you do not purchase the required minimum programming package, your service will be deactivated. Local network channels may be purchased if and where available for an additional $5.00/mo.
Dish Network Programming
A minimum programming package of Americas Top 100, DishLATINO, or Great Wall TV Package is required at all times. In the event you do not purchase the required minimum programming package, your service will be deactivated. Local network channels may be purchased if and where available for an additional $5.00/mo. But come included in a dvr advantage package.
DirecTV Monthly Fees and Payments
You agree to make a monthly payment by the payment due date for the programming you select and for the following fees as applicable depending on the equipment you select:
- Equipment Rental Fee: An equipment rental fee of $5.00 per month for the first receiver activated is included in the promotional base programming package price. An additional equipment rental fee of $5.00 per month will be charged to your account for each receiver activated beyond the first;
- DirecTV DVR Service Fee: A $5.98 per month DirecTV DVR service fee will be charged to your account for each DVR receiver activated. This fee will not apply with respect to one (1) such receiver if you subscribe to DTV Choice Xtra Plus DVR or Choice Xtra Puls HD DVR;
- Additional Outlet Programming Access Fee: A $5.00 per month additional outlet programming access fee will be charged to your account for each receiver activated beyond the first;
- HD Enabling Fee: A $6.00 per month HD enabling fee will be charged to your account if any HD model receiver is activated. This fee will be waived on a monthly basis if you subscribe to any DTV HD Pak.
The $49.99 activation fee (if applicable) is non-refundable. State and local taxes, or reimbursement charges for gross earnings taxes imposed on satellite providers for transmission of programming in some states, may apply. Other fees may apply as set forth in the Residential Customer Agreement. Different or other payment options may be applicable where billing is provided through a billing agent. All receivers selected by you within the first thirty (30) days of initial activation of your DirecTV account shall be treated as selected by you under this Agreement for all purposes, including, without limitation, with respect to ownership and unreturned equipment fees.
Dish Network Monthly Fees and Payments
You agree to make a monthly payment by the payment due date for the programming you select and for the following fees as applicable depending on the equipment you select:
- Equipment Rental Fee: An equipment rental fee of $6.00 per month (in the case of a model 411, ViP211, ViP222, ViP622, or ViP722 DVR receiver) or $5.00 per month (in all other cases) for the first receiver activated is included in the promotional base programming package price. An additional equipment rental fee of $6.00 per month (in the case of a model 411, ViP211, ViP222, ViP622 or ViP722 DVR receiver) or $5.00 per month (in all other cases) will be charged to your account for each receiver activated beyond the first (for the purpose of determining the amount of this fee, model 411, ViP211, ViP222, ViP622 and ViP722 DVR receivers shall be deemed to be activated prior to all other receivers)
- DISH Network DVR Service Fee: A $5.98 per month DISH Network DVR service fee will be charged to your account for each model 510, 522, 625, ViP622, or ViP722 DVR or HomeZone 1022 receiver activated. This fee will not apply with respect to one (1) such receiver if you subscribe to DishDVR Advantage and will be waived if you subscribe to America's Everything Pak;
- Additional Outlet Programming Access Fee: A $5.00 per month additional outlet programming access fee will be charged to your account for each dual tuner receiver (models 322, 522, 625, ViP222, ViP622, or ViP722 DVR and HomeZone 1022) activated. This fee will be waived on a monthly basis for each such receiver that DISH Network confirms has been continuously connected to your same land-based phone line. DISH Networkâs confirmation process shall be the sole method utilized to determine if your additional outlet programming access fee(s) will be waived;
- HD Enabling Fee: A $7.00 per month HD enabling fee will be charged to your account if any model 411, ViP211, ViP222, ViP622 or ViP722 DVR receiver is activated. This fee will be waived on a monthly basis if you subscribe to DishHD or HD Pak (only available to residents of Alaska and Hawaii).
The lease upgrade fee of up to $99.00 for the second model 522, 625 or HomeZone 1022 receiver is not a deposit and is non-refundable. The $29.99 activation fee (if applicable) is non-refundable but will not be credited on your first account billing statement solely in the event that you are a new, first-time DISH Network subscriber who agrees to the eighteen month agreement by Electronic Tweentyfour Month Agreement Acceptance. State and local taxes, or reimbursement charges for gross earnings taxes imposed on satellite providers for transmission of programming in some states, may apply. Other fees may apply as set forth in the Residential Customer Agreement. Different or other payment options may be applicable where billing is provided through a billing agent. DirecTV Unreturned Equipment Charges
This promotion allows you to use the satellite receiver(s), smart card(s) and remote control(s), low noise block converters with integrated feeds ("LNBFs"), BBC module(s), and switches (if any) you select under this promotion while you remain an active customer in good standing and in compliance with this Agreement and the Residential Customer Agreement. All such equipment is owned by DirecTV at all times and must be returned if you elect to terminate this Agreement or downgrade your programming below required minimum programming package of DTV FAMILY, Choice, or LATINO Basico TV Package, or your service is otherwise disconnected for any reason at any time. WITHIN FIFTEEN (15) DAYS OF SUCH TERMINATION, DOWNGRADE, OR DISCONNECTION, YOU AGREE TO RETURN ALL SUCH EQUIPMENT IN GOOD OPERATING CONDITION, NORMAL WEAR AND TEAR EXCEPTED, TO: (1) your original retailer (Installation Company)(or DirecTV if no retailer was used) if such termination, downgrade, or disconnection occurs during the first 180 days after activation of programming, or (2) DirecTV if such termination, downgrade, or disconnection occurs after the first 180 days from the date of activation of programming. If such termination, downgrade, or disconnection occurs after the first 180 days, you agree to immediately call DirecTV at 1-800-494-4388 to receive a return authorization number and delivery instructions for the return of such equipment to DirecTV. You are responsible for and shall bear all costs and expenses to return such equipment. IF YOU FAIL TO RETURN SUCH EQUIPMENT AS SET FORTH HEREIN, YOU AGREE TO PAY, AND WE WILL AUTOMATICALLY CHARGE TO YOUR DirecTV ACCOUNT OR YOUR CREDIT CARD (AS DEFINED BELOW), AT OUR OPTION, AN UNRETURNED EQUIPMENT CHARGE FOR EACH ITEM NOT RETURNED AS FOLLOWS (in each case and collectively, the "Unreturned Equipment Charge"): model HR10, HR20, HR21 receiver, $400.00; model R10, R15 receiver, $300.00; model H10, H20, H21 receiver, $200.00; model D10, D11, D12 receiver, $100.00; outdoor LNBF and quad switch, $100.00.
Dish Network Unreturned Equipment Charges
This promotion allows you to use the satellite receiver(s), smart card(s) and remote control(s), low noise block converters with integrated feeds ("LNBFs"), and switches (if any) you select under this promotion while you remain an active customer in good standing and in compliance with this Agreement and the Residential Customer Agreement. All such equipment is owned by DISH Network at all times and must be returned if you elect to terminate this Agreement or downgrade your programming below required minimum programming package of DishFAMILY, Americaâs Top 100, DishLATINO, or Great Wall TV Package, or your service is otherwise disconnected for any reason at any time. WITHIN FIFTEEN (15) DAYS OF SUCH TERMINATION, DOWNGRADE, OR DISCONNECTION, YOU AGREE TO RETURN ALL SUCH EQUIPMENT IN GOOD OPERATING CONDITION, NORMAL WEAR AND TEAR EXCEPTED, TO: (1) your original retailer (or DISH Network if no retailer was used) if such termination, downgrade, or disconnection occurs during the first 180 days after activation of programming, or (2) DISH Network if such termination, downgrade, or disconnection occurs after the first 180 days from the date of activation of programming. If such termination, downgrade, or disconnection occurs after the first 180 days, you agree to immediately call DISH Network at 1-888-220-3474 to receive a return authorization number and delivery instructions for the return of such equipment to DISH Network. You are responsible for and shall bear all costs and expenses to return such equipment. IF YOU FAIL TO RETURN SUCH EQUIPMENT AS SET FORTH HEREIN, YOU AGREE TO PAY, AND WE WILL AUTOMATICALLY CHARGE TO YOUR DISH NETWORK ACCOUNT OR YOUR CREDIT CARD (AS DEFINED BELOW), AT OUR OPTION, AN UNRETURNED EQUIPMENT CHARGE FOR EACH ITEM NOT RETURNED AS FOLLOWS (in each case and collectively, the "Unreturned Equipment Charge"): model ViP622 or ViP722 DVR receiver, $400.00; model ViP222, 625, 522 or HomeZone 1022 receiver, $300.00; model 322, 411 or ViP211 receiver, $200.00; model 111, 301, 311, or 381 receiver, $100.00; outdoor LNBF and quad switch, $100.00.
Returning Equipment To Hughes
Upon termination of Service, Lease customers are required to return the modem, power supply, and radio (outdoor transmitter) to Hughes. The equipment must be received in good condition within 45 days of termination in order to avoid the Unreturned Equipment Fee. An Unreturned Equipment Fee of $300 will be charged to your account for Equipment not returned within the allotted time frame. Partial returns will be given credit as follows: Modem & Power Supply $100; Radio $200.
Customers who purchased HughesNet equipment may return the modem, power supply, and radio to Hughes upon account termination. All equipment must be received in good condition within 45 days of termination in order to receive a $200 refund.
For customers eligible or required to return equipment, Hughes will provide instructions on how to de-install and return the required equipment. You are not required to return, and Hughes is not obligated to de-install, the antenna, mount, or any cables. If you elect to have the complete system or the antenna, mount and any cables professionally de-installed, you will be responsible for all applicable de-installation charges. You will not receive a credit for installation charges or other fees.
Collection of Fees/Credit Card Authorization
You hereby authorize DirecTV, Dish Network, or HughesNet to charge, and/or place a hold with respect to, any and all cancellation fee(s) and unreturned equipment fee(s) owing under this Agreement (collectively, the Authorized Amounts), to your credit card or debit/check card that you initially provided to DirecTV, Dish Network, HughesNet and/or to any other credit card or debit/check card of yours that you provide to make payments to DirecTV, Dish Network, or HughesNet (the Credit Card), authorize the issuer of the Credit Card to pay the Authorized Amounts without DirecTV, Dish Network, or HughesNet submitting a signed receipt, and agree that this Agreement is to be accepted as such authorization. You authorize DirecTV, Dish Network, or HughesNet to continue to attempt to charge, and/or place holds with respect to, the Authorized Amounts, or any portion thereof, to the Credit Card until such amounts are paid in full. You acknowledge and agree that DirecTV, Dish Network, or HughesNet shall have no liability whatsoever for any non-sufficient funds, rejected debit, or other charges incurred by you as a result of such attempts to charge, and/or place holds on, the Credit Card. Payment of a cancellation fee shall not relieve you of your obligation to pay all unpaid charges on your account. In the event that you are enrolled or later enroll in DirecTV's, Dish Network's, or HughesNet's AutoPay (AutoPay) or Electronic Funds Transfer (EFT) payment programs, you agree that the Authorized Amounts and any and all monthly programming, pay-per-view, and other similar and related charges and other amounts owing under this Agreement or the Residential Customer Agreement may be charged to the credit card, debit/check card or account provided by you to DirecTV, Dish Network, or HughesNet pursuant to such AutoPay or EFT program.
Billing Agents
We may enter into relationships with third parties to provide billing and other services on our behalf in which case the terms and conditions of this Agreement shall apply to such third parties as applicable under the circumstances.
